1. Provider and scope
UpLearn is provided by Dennis Herbrik, Weilimdorfer Straße 103, 70469 Stuttgart, Germany. Contact: dennisherbrik1988@gmail.com.
These Terms apply to the creation of an account and use of the UpLearn website and beta features. By creating an account, you agree to these Terms and acknowledge the Privacy Policy. UpLearn is not directed at children under 16.
2. Accounts and security
- You must provide accurate account information and keep your login credentials secure.
- Email-and-password accounts must verify their email address before authenticated features can be used.
- You may not share an account in a way that compromises security or misuse another person's account.
- You can permanently delete your account through the account settings.
3. Beta service and availability
UpLearn is currently offered as a beta. Features may be incomplete, changed or temporarily unavailable. Maintenance, security issues or technical limitations may interrupt access. No particular availability level is promised for the free beta.
The public beta provides free learning content. Any visible payment integration is restricted to sandbox testing and does not enable users to make real purchases. Separate terms and consumer information will be provided before live paid services are offered.
4. User content and permitted use
You retain rights to content you upload or create. You grant UpLearn the rights necessary to store, process, display and technically reproduce that content for providing the service. If you publish a course, this permission also includes making the course available to other UpLearn users until it is unpublished or deleted.
You may upload or publish content only if you have the necessary rights and permissions. You must not:
- upload unlawful, infringing, abusive or malicious content;
- attempt to bypass access controls, rate limits or security mechanisms;
- use automated access that unreasonably burdens the service; or
- use UpLearn in violation of applicable law or third-party rights.
5. AI-generated and educational content
AI-generated learning material can be incomplete, inaccurate or misleading. It is provided as a learning aid and must be reviewed critically. UpLearn does not provide professional, medical, legal, financial or other regulated advice, and it does not guarantee a particular learning outcome.
6. Moderation and account restrictions
Content may be removed and accounts may be restricted or terminated where reasonably necessary to protect users or the service, comply with law, investigate security incidents or respond to a material breach of these Terms. Where appropriate, the user will be informed and given an opportunity to respond.
7. Liability
Statutory liability applies without limitation for intent, gross negligence, injury to life, body or health, fraudulent concealment, guarantees and liability under mandatory law.
For ordinary negligence, liability is limited to breaches of essential contractual obligations and to foreseeable, typical damage. Otherwise, liability for ordinary negligence is excluded to the extent permitted by law. Mandatory consumer rights remain unaffected.
8. Changes and applicable law
These Terms may be updated when the service or legal requirements change. Material changes affecting registered users will be communicated reasonably in advance where required. The version shown here is the current version.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections of the country in which a consumer habitually resides remain unaffected.
